AZDriverSafety.com Policies and Procedures: Welcome and thank you for taking the time to carefully review the following details.
Each day, millions of people get in a vehicle to reach a destination. Whether they are going to work, an appointment or a leisurely drive, each motorist is at risk once they put the key in the ignition. The difference between reaching their destination safely or not at all depends on their knowledge of the driving laws, attentiveness and the defensive driving techniques they employ.
The act of driving safely is too often overlooked with dire consequences. By teaching just one driver proper driving techniques, we can save several lives potentially. If we teach thousands of drivers, we can save MILLIONS of lives.
This course was designed to promote respect for, and encourage observance of traffic laws and traffic safety responsibilities of drivers and citizens; reducing traffic violations; reducing traffic-related injuries, deaths, and economic losses; and motivating continuing development of traffic-related competencies.
Minimum Course Completion Standards:
By registering and participating in this Arizona defensive driving course (DDC), you, the registrant hereafter named "PARTICIPANT" do hereby agree to the following course policies and procedures:
Course Time Management: AZDriverSafety.com is a timed course which means the total length of the course shall consist of a minimum of 240 minutes and a maximum of 270 minutes. Any student that does not receive at least 240 minutes of instruction shall not be entitled to a certificate of completion.
Course Hardware: AZDriverSafety.com has been designed to work on virtually any computer, MAC or device with an internet connection. To participate, each user must have an internet connection, (preferably broadband) an internet browser (internet explorer, Mozilla or Chrome will work). Adobe Flash player is recommended but not required. Speakers to hear the course videos are recommended but not required as the videos have subtitles and are optional.
Course Fees:
The course tuition fee is $37.95. This fee includes course instruction and an e-mailed certificate of completion upon successful course completion.
In addition to collecting a course tuition fee, each defensive driving course provider in Arizona must collect all State and court fees due. The State fee is $24, the State surcharge fee is $45 and the court fees vary. For a full listing of the court fees, please visit our "course fees" page located on the homepage.
Refund Policy:
AZDriverSafety.com strives to ensure each registered student is happy with the program and will do everything within our abilities to ensure complete customer satisfaction. The following policy outlines our company's policy regarding refunds of fees paid. These policies have been produced to comply with Arizona State law, AJCA § 7-205(F)(28).
As a licensed school, it is our duty to comply with Arizona State Law and no member of our staff can make an exception to the policies included below.
Once a person begins a defensive driving course, the state fee, court diversion fee and state surcharge are non-refundable except as set forth in this subsection.
Course tuition fee: Our school may only refund course tuition fees under certain circumstances, such as natural disaster, personal emergencies or if the student has no reasonable means to complete our internet based program, or at the direction of a court.
Court diversion fee, State fee or State surcharge: Our school shall provide a refund of court diversion, state fees and the state surcharge when:
(1) A student pre-pays for a defensive driving course, does not begin the course and does not contact the school to reschedule for a future course. The school shall refund the court diversion fee, state fee and state surcharge 30 days after the scheduled defensive driving course date or upon notification from the student the student will not attend a course, whichever is first;
(2) An officer fails to file a citation with a court and the cited person attends a defensive driving course for that citation. Upon notification by the jurisdictional court, the school shall notify division staff a refund is requested. Upon written approval by division staff, the school shall refund the court diversion, state fee and state surcharge to the student; or
(3) A citation is dismissed by a jurisdictional court on its own motion, for technical problems not correctable under civil traffic rules of court.
A refund of the court diversion fee, state fee or the state surcharge shall result in restoration of the student's eligibility for a defensive driving course.
Our school cannot refund the state fee or state surcharge for any student failing the required course participation questions but must forward the state fee and state surcharge to the Arizona Supreme court.
Refund of state fees and state surcharges is not permitted for an ineligible violation or an ineligible student who attends a defensive driving course, whether by fault of the student or school.
Course refunds are granted only under the following conditions: (1)You pay for the course but do not begin participation, (2) the officer does not file the citation with the court or (3) the citation is dismissed by the court.
Course Participation Questions:
Per State rule, we must verify that each participant has reviewed the course and is actively participating. To confirm each user's course participation, there are 3 questions asked at the end of section of reading. These questions are multiple choice and are based on items highlighted in the course reading. We have done our best to make these course participation questions as easy as possible for an individual that has actively participated in the course. You will have multiple chances to pass these questions as a chance to review the course reading for review if you need to.
Personal Validation:
During the course, your identity must be verified a number of times. This ensures that the correct person is taking the course and allows our programming to track your progress in real-time. Validation of your identity is achieved through the use of personal validation questions. The course will ask personal validation questions throughout the course. These questions are based on your personal preferences. If you miss 2 questions in succession you will locked out of the program and required to start the course over again, resetting time and participation spent. Our school cannot refund the course fee, state fee or state surcharge for any student failing personal validation questions.
Privacy Policy:
AZDriverSafety.com makes every effort to ensure the privacy of your information. Credit card information retained by AZDriverSafety.com is processed only through SSL encryption and student data is secured in a similar fashion, with only course representatives having access to your personal details. Student credit card numbers are not kept on file and no individual within the company has access to these credit card numbers.
AZDriverSafety.com does not maintain printed copies of student files. We feel this is not only a waste of natural resources, but increases the likelihood that these records may be misplaced or mishandled. Each student record is maintained by the company server, in a secure environment. Identifying information (name, address, drivers license, phone number, DOB, violation information, answers to security questions) disclosed by clients will only be for purposes of ticket diversion and must be kept for a minimum of 3 years before deletion.
SMS messaging:
By texting us at the provided number you agree to receive sms/text messages from our company regarding your account. We will never send you promotional texts or sell your data to a 3rd party. This agreement isn't a condition of any purchase. by texting our company you also agree to the Terms of Service and Privacy Policy. Msg & Data rates may apply. At no time shall AZDriverSafety.com sell or distribute your personal information to any 3rd party, other your court of jurisdiction and the Arizona Supreme Court.
Eligibility Requirements for Taking this Defensive Driving Course
To be eligible for traffic ticket dismissal, you meet the following requirements:
1. You have not attended a defensive driving course for a traffic citation within the past 12 months.
2. Your citation/violation must be on the list of eligible violations for dismissal. This list is available during course registration. If your violation does not appear on this list, do NOT continue with the registration and call our office (877) 848-5754 for instructions.
3. If eligible, you can attend for one violation only.
4. If you were involved in a serious injury or fatal accident you are not eligible.
5. If you hold a commercial driver's license (CDL holder), you are eligible for diversion of a violation only if the vehicle you were driving at the time of the violation is NOT a commercial vehicle.
6. You must complete your course at least 7 days prior to your court date.
Cheating/ Fraud:
Students that are caught cheating will be locked out of the program referred to their court of jurisdiction and not entitled to a refund of any sort.
Indemnification:
You agree that you will indemnify and hold harmless AZDriverSafety.com, its affiliated companies and their officers, directors, employees and shareholders from any and all damages, fines, penalties or any other liabilities imposed by local, state or federal laws or regulations or claimed by any third party, including attorneys fees, which result from or arise out of your providing your personal data or information, or your use of the certificate of completion in connection to your participation of the services provided by AZDriverSafety.com.
Limitation of Liability:
Participant acknowledges and agrees that the liability of AZDriverSafety.com (DDC) and their agents and employees for any act, omission to act, or negligence on the part of COURSE PROVIDER (DDC) and their agents and employees, is strictly limited to and shall not exceed the amount of the registration fee actually paid by Participant.
Participant Representations and Warranties: Participant represents and warrants that the user information and registration information provided by Participant is true and correct, and acknowledges that the truth and accuracy of such information is a material inducement to DDC in permitting Participant to enroll in the course. Participant further acknowledges and agrees that any willful or intentional misrepresentation by Participant regarding such user information or registration information constitutes a breach of this agreement and of the representations and warranties by Participant as provided in this agreement, and may subject student to liability for damages incurred by DDC as a result thereof, including but not limited to general, consequential, and punitive damages.
Participant Acknowledgements:
1) I have been furnished a copy of the course fees schedule; privacy and refund policy; and school regulations pertaining to requirements for successful completion of the course, passing rates for course content and environmental questions, criteria for passing the course and the penalties for fraud.
(2) The school and course provider are prohibited from issuing a uniform certificate of course completion if the student has not met all of the requirements for course completion, and the student should not accept a uniform certificate of course completion under such circumstances.
(3) This agreement constitutes the entire contract between the school and the student, and verbal assurances or promises not contained herein shall not bind the school or the student.
Contracts executed in an electronic format shall be considered to contain original signatures for purposes of this section.
